Agreement to Terms
By submitting a digitization request, creating a customer account, or otherwise using the Appalachian Archives website and services, you agree to these Terms of Service. If you don't agree, please don't use our services.
Our Services
Appalachian Archives provides digitization of tapes (VHS, Hi8, MiniDV, Betamax), 8mm and Super 8 film, photos, and audio cassettes into digital formats, along with secure digital archiving and delivery of the resulting files. Current pricing is listed on our Pricing page and is subject to change.
Submitting Media
When you submit physical media to us for digitization, you confirm that you own the media or have the right to have it digitized. We handle all submitted media with care, but we are not responsible for pre-existing damage, degradation, or playback issues inherent to aging analog media that are discovered during the digitization process. Original physical media is returned to you along with your digital copies unless other arrangements are made.
Your Account
Your customer portal account gives you access to your digitized media. You're responsible for keeping your login credentials secure and for any activity that occurs under your account. Let us know immediately if you believe your account has been accessed without your permission.
Sharing Your Media
Our portal lets you generate a private share link so someone else can view a video without creating an account. You are responsible for who you choose to share a link with — anyone with the link can view that video until you revoke it. Please only share links with people you trust with that content.
Ownership
You retain full ownership of the media you submit and the digital files we produce from it. We claim no ownership rights over your content. We may use anonymized, non-identifying information about completed projects (for example, aggregate statistics) to improve our services, but we will not use your personal media publicly without your permission.
Acceptable Use
You agree not to use our services to submit or request digitization of media you don't have the right to reproduce, or to attempt to access another customer's account, media, or share links without authorization.
Payment
Pricing for digitization services is provided on our Pricing page or as a custom quote for institutional requests. Payment terms will be confirmed with you when your request is reviewed.
Limitation of Liability
While we take significant care with every project, Appalachian Archives is not liable for indirect, incidental, or consequential damages arising from the use of our services, including but not limited to loss of media that was already damaged prior to submission. Our total liability for any claim related to our services is limited to the amount you paid for the specific project in question.
Changes to These Terms
We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms. Material changes will be reflected by an updated "Last updated" date at the top of this page.
Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law principles.
